These Terms were drafted in English. Any translation is provided for information only; if a translated version conflicts with the English version, the English version prevails.

These Terms of Service ("Terms") are a legally binding agreement between you, whether acting individually or on behalf of an entity, and grape ("grape," "we," "us," or "our"), governing your access to and use of grape.hot, app.grape.hot and every related site, feature and service (together, the "Service"). Our privacy policy, content policy, 18 U.S.C. §2257 statement and any supplemental rules we post on the Service are incorporated into these Terms by reference.

Section 24 contains a class-action waiver that affects how disputes are resolved. By accessing or using the Service in any way you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to all of them, you are prohibited from using the Service and must stop immediately. You may stop using the Service at any time. We recommend that you print or save a copy of these Terms for your records.

1. adult content warning

The Service contains sexually explicit material, including visual, audio and written depictions of nudity and actual or simulated sexual activity, that could harm the physical, mental or moral development of minors. It is intended for adults only, and not for anyone who is offended by such material or for whom viewing it is illegal where they are.

2. eligibility and your affirmations

By accessing the Service you represent and warrant, under penalty of perjury, that:

  • you are at least 18 years old, or the age of majority where you live and access the Service, whichever is higher, and you have the legal capacity to enter into these Terms;
  • you are voluntarily choosing to view sexually explicit material for your own private, non-commercial use, and you will not expose minors or anyone who has not consented to it;
  • viewing, downloading or possessing adult material is legal in your community and jurisdiction, and you are solely responsible for complying with your local laws;
  • you are familiar with sexually explicit material, believe that sexual acts between consenting adults are neither offensive nor obscene, and believe that the material on the Service does not violate the standards of your community;
  • you are not barred from using the Service under any applicable law, and we have not previously suspended or removed your account;
  • you are not located in a country subject to comprehensive sanctions, and you are not named on, or owned or controlled by anyone named on, any government sanctions or restricted-party list;
  • you will not alter, delete or add to any part of these Terms; any attempt to do so is void.

The Service is not intended for distribution to or use by anyone in any jurisdiction where that would be contrary to law or would subject us to any registration requirement there. If you access the Service from such a place, you do so on your own initiative and at your own risk.

Minors are strictly prohibited. We may require age or identity verification at any time, and may suspend access until it is completed. The Service is labelled with the RTA ("Restricted To Adults") label. Parents: you can block access to the Service using the parental controls built into your child's device or offered by your internet service provider, or third-party filtering apps. 3. your account

You must provide accurate, current and complete information when you register and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account, whether or not you authorised it. Accounts are personal: you may not sell, transfer or share yours. Notify us immediately at legal@grape.hot of any unauthorised use. We are not liable for losses caused by anyone using your credentials. If any information you provide is false, inaccurate, outdated or incomplete, we may suspend or terminate your account.

4. licence to use the service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Service for your own private, non-commercial use. Except where a feature of the Service expressly allows it, you may not copy, download, record, reproduce, redistribute, broadcast, publicly display, sell, license, sublicense or create derivative works from any content on the Service. All rights not expressly granted are reserved.

5. prohibited conduct

You may use the Service only for the purposes we provide it for. You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms or our content policy;
  • scrape, crawl, spider, frame, mirror, or use any bot, script, data-mining tool, offline reader or other automated means to access the Service or to collect content or data from it, except standard search-engine indexing and ordinary browser use;
  • systematically collect content or data to build a collection, compilation, database or directory;
  • circumvent, disable or interfere with any security, access-control, age-verification, copy-protection or rate-limiting feature;
  • rip, re-host or redistribute videos, link to them in a way that bypasses our pages, or remove any copyright or proprietary notice;
  • copy, adapt, decompile, disassemble or reverse-engineer any software that forms part of the Service, except as the law expressly permits;
  • impersonate any person or use another user's username, or misrepresent your affiliation with anyone, including performers or grape staff;
  • deceive or defraud us or other users, including attempts to obtain passwords or other account information;
  • harass, threaten, stalk, dox, extort, abuse or defame anyone, including our staff and contractors, or use information obtained from the Service to harm others;
  • collect usernames, email addresses or other personal information to send unsolicited messages, or create accounts by automated means or under false pretences;
  • advertise or solicit prostitution, escort services, trafficking or any commercial sex act, or post advertising or commercial solicitations we have not approved;
  • send spam or chain messages, or upload or transmit viruses, malware, spyware, web bugs, tracking pixels or any other harmful or passive data-collection mechanism;
  • probe, scan or test the vulnerability of the Service, or interfere with, disrupt or place an undue burden on it or its networks, except through a responsible-disclosure report to legal@grape.hot;
  • misuse our support channels or submit false or bad-faith reports of abuse, infringement or misconduct;
  • create multiple accounts to evade a suspension, ban or limit, or manipulate views, votes, rankings, points or earnings;
  • use a purchasing agent to make transactions, or use the Service to launder money, fund illegal activity or evade sanctions;
  • use the Service to build a competing product, or for any commercial purpose we have not approved;
  • interfere with our efforts to fight child sexual abuse, non-consensual content, terrorism or violent extremism.

6. content you upload

Only verified creators may upload. You are fully responsible for every piece of content you submit — including videos, images, titles, descriptions, comments and messages ("Your Content") — and for the consequences of publishing it. For all of Your Content you represent and warrant that:

  • (a) you own or have all necessary rights, licences and permissions to Your Content and to grant the licence below;
  • (b) every person depicted was at least 18 years old, or the age of majority in their jurisdiction if higher, when the content was created, consented to being recorded, and gave written consent and a release for their name and likeness to be used and for the content to be published on an adult website, including on grape;
  • (c) you are the "producer" of Your Content for the purposes of 18 U.S.C. §2257 and 28 C.F.R. Part 75, you create and maintain all records those laws require, and you will provide copies to us within 72 hours of a request;
  • (d) Your Content does not infringe any third party's copyright, trademark, trade secret, privacy, publicity or other rights, and does not violate any law or our content policy;
  • (e) you will report to us immediately if any person depicted revokes their consent;
  • (f) you are solely responsible for paying any royalties, residuals, reuse fees or other amounts owed to anyone in connection with Your Content.

You retain ownership of Your Content. You grant grape a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, transcode, adapt (for example into different formats, resolutions and thumbnails), display, perform, distribute and promote Your Content in connection with operating, providing and marketing the Service. This licence ends when Your Content is removed from the Service, except for copies held in backups for a reasonable period, copies retained to meet legal obligations (including 2257 and law-enforcement requests), and content others have already lawfully shared.

You consent to our sharing Your Content, your account information and related records with law enforcement and child-protection authorities, including the National Center for Missing & Exploited Children (NCMEC), in connection with any investigation of child sexual abuse material, non-consensual content or other unlawful activity. We do not endorse any user content, and we are not a joint controller of any third party's personal data contained in Your Content.

Creators are independent. Nothing in these Terms makes you our employee, agent, partner or joint venturer, and you are solely responsible for the production of Your Content, for the people who appear in it, and for your own compliance with the laws that apply to you as a creator, including tax, labour, health-and-safety and record-keeping laws.

7. prohibited content

You may not upload, post or share content that: involves anyone under 18, real or simulated, including AI-generated, animated or "age-play" content that appears to involve a minor; was recorded or published without the consent of every identifiable person; depicts non-consensual acts, rape, real violence, torture, death, bestiality, necrophilia, incest or coprophilia, whether real, staged or simulated; is a deepfake of a real, identifiable person; depicts illegal drug use; is hateful or harassing, or promotes violence or criminal behaviour; infringes third-party rights; or violates any applicable law. The full list is in our content policy. Child sexual abuse material is reported to NCMEC and to law enforcement, and accounts involved are permanently banned.

8. terrorism and violent extremism

The Service may not be used to depict, promote or support terrorism or violence. Content of that kind — including videos, descriptions, comments, messages, audio and external links — is removed and, where the law requires, reported to law enforcement. This includes content that:

  • threatens violence or wishes serious harm, death or disease on individuals or groups;
  • praises, glorifies, justifies or memorialises terrorist attacks, mass shootings or other violence against civilians, or the people and organisations responsible;
  • is produced by or in support of terrorist, violent extremist or criminal organisations, or uses their insignia, logos or symbols to promote them;
  • recruits for, fundraises for, or otherwise supports such organisations, or directs users to sites that do;
  • incites or solicits others to commit violence or join such organisations;
  • gives instructions for making or using explosives, firearms or other weapons, or for committing violent acts;
  • depicts hostages, or is used to threaten or intimidate on behalf of such organisations;
  • shows real footage of accidents, disasters, violence, injured or dead bodies, or perpetrator-filmed violent events, intended to shock or disgust.

9. moderation and management of the service

Every upload is reviewed by a person before it is published, and decisions to remove content are made by our moderators. We may, but are not obliged to: monitor the Service for compliance with these Terms; refuse, remove, age-gate, restrict or disable any content at any time and for any reason, without notice or liability, including files that are excessively large or burden our systems; take legal action against anyone who violates the law or these Terms, including reporting them to law enforcement; and otherwise manage the Service to protect our rights and property and keep it working. Moderation does not make grape responsible for user content; uploaders remain solely responsible for it.

10. reporting, takedowns and removal orders

Anyone can report content using the report button on every video or by email (see contact). We review reports within 24 hours, and reports of non-consensual content or a suspected minor within 2 hours, removing content first and investigating after. If you appear in content on the Service without your consent, email ncii@grape.hot and we will take it down.

Official removal orders and other notices from public authorities, including orders concerning terrorist content and reports from trusted flaggers, can be sent in English to legal@grape.hot, which is our single point of contact for authorities. We act on valid orders as quickly as possible and within the time limits the law requires.

11. copyright and DMCA

We respect intellectual property and respond to notices that comply with the Digital Millennium Copyright Act, 17 U.S.C. §512. Send notices to our designated agent at dmca@grape.hot, including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the URL(s) of the allegedly infringing material; (4) your name, address, telephone number and email; (5) a statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address containing the information required by 17 U.S.C. §512(g)(3). We may restore the content 10 to 14 business days after receiving a valid counter-notice unless the complainant tells us they have filed a court action. Anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages under 17 U.S.C. §512(f). We terminate the accounts of repeat infringers.

12. our intellectual property

Except for user content, the Service and everything in it — including its software, code, design, text, graphics, audio and video, databases, the selection and arrangement of content, its look and feel, and the "grape" name, logos and other marks — is owned by or licensed to grape and protected by copyright, trademark and other laws. You may not copy, reproduce, distribute, display, sell, license or otherwise use any of it, or our marks, without our prior written consent. If you send us feedback or suggestions, we may use and share them for any purpose without any obligation to you.

13. payments, balances and subscriptions

Some features let you deposit cryptocurrency to fund an account balance, subscribe to creators, and earn or redeem points. By using them you agree that:

  • deposits are credited at the market value we determine when the deposit is confirmed on-chain; blockchain transactions are irreversible, and you are responsible for sending only supported assets to the correct address and network;
  • your balance and points are a record of credit for use on the Service only. They are not a bank account, deposit, security or e-money, earn no interest, and have no value outside the Service except as redeemable or withdrawable under our published rules and minimums;
  • subscriptions renew automatically at the then-current price until you cancel, and cancellation takes effect at the end of the current period;
  • except where the law requires otherwise, all purchases, subscriptions and tips are final and non-refundable;
  • you are responsible for any taxes on amounts you pay or earn, and creators are responsible for reporting their own income;
  • we may delay, hold or refuse any deposit, withdrawal, redemption or payout we reasonably suspect involves fraud, chargebacks, stolen funds, money laundering, sanctions violations or a breach of these Terms, and may reverse credits obtained that way;
  • we may change prices, fees, minimums and supported assets at any time, with notice on the Service for changes that affect you.

14. third-party links and services

The Service may link to or rely on third-party sites and services, such as identity-verification providers and blockchain networks. We do not control them and are not responsible for their content, policies, availability, products or acts, or for any transaction between you and them. Your use of them is at your own risk and subject to their terms.

15. content from other users

Most content on the Service is provided by users. You may encounter content you find inaccurate, offensive or objectionable. We do not endorse user content, and to the extent permitted by law you waive any legal rights or remedies you may have against grape with respect to it.

16. your data

We process the information you provide, and data about your use of the Service, as described in our privacy policy. Although we back up our systems routinely, you are responsible for keeping your own copies of anything you upload or send through the Service, and we are not liable for any loss or corruption of that data.

17. electronic communications and signatures

Using the Service, emailing us and submitting online forms are electronic communications. You consent to receive communications from us electronically, by email or through the Service, and agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing. You agree to the use of electronic signatures, contracts, orders and records, and waive any requirement under any law for an original signature or non-electronic records or delivery.

18. termination

These Terms apply for as long as you use the Service. We may suspend or terminate your access to all or part of the Service, block IP addresses, and remove any content or information you have posted, at any time, with or without notice, for any violation of these Terms or the law, any suspected unlawful activity, or to protect the Service, our users or third parties. If we suspend or terminate your account, you may not register a new one under your own name, a false or borrowed name, or anyone else's name. We may also pursue civil, criminal and injunctive remedies.

You may close your account at any time by contacting legal@grape.hot. Where an account is closed for reasons other than fraud or a breach of these Terms, we will let you withdraw any legitimately held balance that meets our minimums. Sections that by their nature should survive termination — including your content warranties, licences granted to us, disclaimers, limitation of liability, indemnification and dispute terms — survive.

19. changes, interruptions and corrections

We may change, suspend or discontinue any part of the Service, or any content on it, at any time and without notice, and are not liable to you or anyone else for doing so. We do not guarantee the Service will always be available: hardware or software problems and maintenance may cause interruptions, delays or errors, and we are not responsible for any loss or inconvenience they cause. Nothing in these Terms obliges us to maintain or support the Service or provide updates. The Service may contain typographical errors, inaccuracies or omissions, including in descriptions and pricing; we may correct them and update information at any time without notice.

We may update these Terms at any time for any reason. The date at the top shows when they last changed, and for material changes we will also give notice on the Service; you waive any right to receive specific notice of any other change. It is your responsibility to review these Terms periodically. Continued use after changes take effect means you accept the updated Terms.

20. disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND YOUR USE OF THEM IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT IT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE OR LIABLE FOR: (1) ANY ERRORS, MISTAKES OR INACCURACIES IN CONTENT; (2) ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE; (3) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL OR FINANCIAL INFORMATION STORED ON THEM; (4) ANY INTERRUPTION OF TRANSMISSION TO OR FROM THE SERVICE; (5) ANY BUGS, VIRUSES OR SIMILAR CODE TRANSMITTED THROUGH THE SERVICE BY THIRD PARTIES; OR (6) ANY LOSS OR DAMAGE INCURRED AS A RESULT OF USING ANY CONTENT POSTED OR MADE AVAILABLE THROUGH THE SERVICE.

21. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAPE AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR DIGITAL ASSETS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$100. Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you and you may have additional rights.

22. indemnification

You agree to defend, indemnify and hold harmless grape and its affiliates, owners, officers, employees, contractors, agents, partners and licensors from any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (1) Your Content; (2) your use of the Service; (3) your breach of these Terms or of any representation or warranty in them; (4) your violation of any law or third-party right, including intellectual-property and privacy rights and any failure to maintain records required by 18 U.S.C. §2257; or (5) any harmful act toward another user. We may assume the exclusive defence and control of any matter you must indemnify, at your expense, and you will cooperate with us. We will make reasonable efforts to notify you of any such claim once we become aware of it.

23. governing law and venue

These Terms and any dispute arising from them or from the Service are governed by the laws of the jurisdiction in which grape is established, without regard to conflict-of-law rules. Subject to section 24, disputes will be resolved exclusively in the courts of that jurisdiction, and you consent to their personal jurisdiction.

24. dispute resolution, arbitration and class-action waiver

Informal negotiation. Before bringing any dispute, controversy or claim relating to these Terms or the Service (a "Dispute"), you agree to send us written notice at legal@grape.hot describing it, and both parties will try in good faith to resolve it informally for at least 90 days.

Binding arbitration. Any Dispute not resolved informally, including any question about the existence, validity, scope or termination of these Terms, will be finally resolved by confidential, binding arbitration before a single arbitrator, under the rules of a recognised arbitral institution, seated in the jurisdiction identified in section 23 and conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. To the fullest extent permitted by law, every Dispute will be resolved only on an individual basis. No arbitration or court proceeding will be consolidated with any other, conducted as a class, collective or representative action, or brought on behalf of the general public or anyone else, and you waive any right to a jury trial. Any claim relating to the Service must be brought within one year after it arises, or it is permanently barred.

Exceptions. The informal-negotiation and arbitration requirements do not apply to: Disputes to enforce, protect or challenge intellectual property rights; Disputes involving allegations of theft, piracy, invasion of privacy or unauthorised use; small-claims actions within that court's jurisdiction; or requests for injunctive relief. If any part of this arbitration provision is found unlawful or unenforceable, neither party will arbitrate the Disputes covered by that part, which will instead be decided by the courts identified in section 23, and the class-action waiver still applies to the fullest extent permitted.

25. general

These Terms, together with the policies they reference, are the entire agreement between you and grape about the Service and supersede any prior agreements. If any provision is held unlawful, void or unenforceable, it will be enforced to the maximum extent permissible or severed, and the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign any of our rights and obligations at any time, including in connection with a merger, acquisition or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control. These Terms do not create any joint venture, partnership, employment or agency relationship between you and us, and they will not be construed against us because we drafted them. You waive any defence based on the electronic form of these Terms or the lack of a physical signature. Headings are for convenience only.
