record-keeping requirements compliance statement
All models, actors, actresses and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct appearing on or otherwise contained in this website were over the age of eighteen (18) years at the time those depictions were created.
All visual depictions on grape are either (a) exempt from the record-keeping requirements of 18 U.S.C. §2257, 18 U.S.C. §2257A and 28 C.F.R. Part 75, because they do not depict actual sexually explicit conduct as defined in 18 U.S.C. §2256(2)(A)(i)–(iv) or lascivious exhibition as defined in §2256(2)(A)(v), or were created before July 3, 1995; or (b) depictions for which the records required by those provisions are maintained by the producer and the custodian of records identified below.
user-uploaded content
grape is a platform for content uploaded by independent, verified creators. grape is not the primary producer, as that term is defined in 18 U.S.C. §2257(h)(2) and 28 C.F.R. 75.1(c), of any user-uploaded visual depiction. To the extent its activities with respect to that content are limited to transmission, storage, retrieval, hosting, formatting and moderation for compliance with its policies, grape is excluded from the definition of producer by 18 U.S.C. §2257(h)(2)(B)(v) and 28 C.F.R. 75.1(c)(4)(iv).
For each uploaded video, the uploader is the producer and primary custodian of records. Under our terms of service, every uploader represents and warrants that they create and maintain, for every performer in their content, the records required by 18 U.S.C. §2257 and 28 C.F.R. Part 75 — including a legible copy of a current, valid government-issued photo ID establishing the performer's legal name and date of birth, any other names the performer has used, and the date of production — and that they will provide copies to grape within 72 hours of a request. As an additional safeguard, grape keeps verified copies of these records as a secondary custodian.

how we verify
Every uploader must be at least eighteen (18) years old, or the age of majority in their state, jurisdiction or country if higher, and must pass third-party identity and age verification (currently provided by Didit) before their account can upload, share or sell content on grape.
For every upload, the uploader must provide proof of, and certify, that:
- every person depicted was at least 18 years old, or the minimum age in their state, jurisdiction or country if higher, when the content was created;
- every person depicted voluntarily consented to appear in the content at the time it was created, and consented to its publication on grape;
- as the producer of the content, the uploader complies with the record-keeping requirements of 18 U.S.C. §2257 and 28 C.F.R. Part 75 and will provide those records promptly on request;
- the content does not violate our terms of service or any of our policies, including our content policy on child sexual abuse material and non-consensual content.
A government-issued photo ID and a signed model release must be supplied for every identifiable performer in each specific video. Submissions missing either are rejected at pre-moderation. Content we learn was produced without these records, or that depicts anyone under 18, is removed immediately.
retention
Records are retained for at least seven years from the date they were created or last amended or added to, and, if grape ceases to carry on business, for five years after that, in accordance with 28 C.F.R. 75.4.
child protection and reporting
grape has zero tolerance for child sexual abuse material. Any apparent child sexual abuse material is removed and reported to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. §2258A, and the accounts involved are permanently banned. To report content, use the report button on any video or email ncii@grape.hot.
